Acceptable Use Policy

This Acceptable Use Policy (“Policy”) governs the use of products, services, websites, dealer portals, training platforms, software, and technologies (collectively referred to as the “Services”) provided by HealthWay Family of Brands (“HealthWay”, “we”, “our”, or “us”).
This Policy is designed to protect HealthWay, our customers, our authorized dealers, and the broader internet community from unlawful, abusive, harmful, or irresponsible use of our Services.
By accessing or using HealthWay Services, you agree to comply with this Policy.
HealthWay reserves the right to suspend or terminate access to any Services for violations of this Policy.
1. Customer Responsibility
Customers, dealers, partners, and users are responsible for their own actions when using HealthWay Services, as well as the actions of anyone using those Services through their accounts.
Users must:
- maintain the security of login credentials
- prevent unauthorized access to accounts
- ensure that employees, agents, contractors, or end-users comply with this Policy
Any activity conducted through your account may be attributed to you.
HealthWay may investigate complaints or suspected violations and may suspend or terminate accounts where violations occur.
2. Prohibited Activities
HealthWay Services may not be used for activities that are unlawful, abusive, harmful, deceptive, or that interfere with the proper operation of our systems.
Prohibited activities include, but are not limited to:
Illegal Activity
Using HealthWay Services to promote, facilitate, or engage in any activity that violates applicable laws or regulations.
Fraud or Deception
Activities intended to mislead, defraud, impersonate, or deceive others, including:
- impersonating HealthWay or its representatives
- misrepresenting business relationships with HealthWay
- fraudulent marketing or deceptive practices
- phishing or financial scams
Harassment or Harmful Conduct
Using HealthWay Services to harass, threaten, abuse, or harm individuals or groups.
Offensive or Harmful Content
Publishing or distributing content that:
- violates intellectual property rights
- is defamatory
- contains illegal material
- promotes violence or illegal activity
- depicts or distributes child exploitation material
3. Intellectual Property and Content Use
Users may not upload, transmit, publish, or distribute content through HealthWay Services that infringes upon the intellectual property rights of others.
This includes unauthorized use of:
- copyrighted materials
- trademarks
- trade secrets
- proprietary product information
- training materials or documentation
Dealer portal content, training materials, product resources, and marketing assets are the property of HealthWay and may not be copied, resold, redistributed, or publicly distributed without authorization.
4. Messaging and Marketing Compliance
Users must comply with all applicable laws governing digital communications and marketing.
This includes compliance with regulations such as:
- CAN-SPAM Act
- Telephone Consumer Protection Act (TCPA)
- General Data Protection Regulation (GDPR)
- California Consumer Privacy Act (CCPA/CPRA)
- Canada’s Anti-Spam Legislation (CASL)
HealthWay Services may not be used to:
- send unsolicited bulk communications (“spam”)
- use purchased or harvested contact lists without proper consent
- send marketing messages without required opt-in or consent
- disguise the origin of messages
All marketing communications must include proper consent and unsubscribe mechanisms where required by law.
5. System Security and Platform Integrity
Users may not attempt to compromise the security, integrity, or availability of HealthWay systems.
Prohibited activities include:
- unauthorized access to systems, accounts, or data
- attempting to bypass authentication or security controls
- vulnerability scanning or probing without permission
- credential harvesting or brute-force login attempts
- distributing malware or malicious code
- reverse engineering HealthWay systems or software
- scraping or extracting data from HealthWay platforms without authorization
Automated tools, bots, scripts, or artificial intelligence systems may not access or interact with HealthWay Services in ways that disrupt normal operations or extract proprietary data.
6. Platform Misuse
HealthWay Services may not be used in ways that degrade performance or interfere with other users.
This includes:
- excessive automated requests
- system abuse
- unauthorized resale or redistribution of platform access
- sharing dealer portal credentials outside authorized organizations
Dealer access is intended solely for authorized HealthWay partners and may not be sublicensed or transferred.
7. Protection of HealthWay Brand and Systems
Users may not falsely claim association with HealthWay or misuse HealthWay branding.
Prohibited actions include:
- impersonating HealthWay
- falsely presenting products as HealthWay-certified
- creating websites or marketing materials that misrepresent affiliation
- unauthorized use of HealthWay trademarks or branding
8. Enforcement
HealthWay may investigate suspected violations of this Policy.
If a violation is detected, HealthWay may take actions including:
- issuing warnings
- suspending account access
- restricting platform functionality
- terminating accounts
- removing content
- reporting illegal activity to authorities where required
HealthWay may take these actions without prior notice when necessary to protect our systems, customers, or partners.
9. Policy Updates
HealthWay may update this Acceptable Use Policy periodically.
Updated versions will be posted on our website. Continued use of HealthWay Services after an update constitutes acceptance of the revised Policy.
